These Purchase Terms are part of the Seller's obligation in accordance with the provisions of the Consumer Protection Act and serve to ensure that the Buyer, before entering into a distance contract, is informed in a clear and comprehensible manner about a series of circumstances important for the conclusion, execution, termination of the contract, all in accordance with the legal regulations.

The term Seller therefore refers to the trading company TAMO AMO d.o.o.

The term "Buyer" also refers to the consumer: a person who, outside of any activity, orders and pays for any product through the web trade services found on the Seller's website, but also to individual merchants and persons who perform business activities, who are protected by the provisions of the Law on consumer protection only if they buy products unrelated to their business activities, as well as on all other buyers of legal status.

The seller sells through the website www.the-lab.rs. acts on his own behalf.

The conditions of purchase form part of the contract concluded at a distance together with the specifications and price/s of the purchased product/s, so before confirming the order for the purchase of an individual product, the Customer will be asked to accept/declare that he/she is familiar with/agree with them, while after confirmation order (conclusion of the contract) shall be delivered to the Customer as the content of an e-mail message confirming that the contract has been concluded. The seller reserves the right to change the terms and conditions at any time, with the said changes entering into force after publication on these websites.

When the Buyer confirms and executes the order - the contract is concluded, the Seller will confirm the conclusion of the contract immediately by e-mail informing the Buyer that the contract has been concluded.

For a validly concluded contract, it is necessary that the Buyer is a person with full business capacity.

The customer is responsible for the completeness and truthfulness of the data entered during registration.

The terms of purchase are divided into the following categories/information.

Access to the website www.the-lab.rs may sometimes be unavailable due to works, maintenance or the introduction of new content, as well as in cases of unforeseen circumstances beyond the control of the Seller, which the Seller will try to remedy as soon as possible.

MAIN FEATURES OF THE PRODUCT

The main features of the goods: the products are shown descriptively and with photos, the data about the products is compiled from The Lab database. All products, content, prices, guarantees and services within the-lab.rs site are subject to change without prior notice.

Product photos are illustrative in nature, and may not always correspond in all details to the products that are the subject of the order.

The seller especially points out that the visual identity of the product shown in the photo may not correspond to the appearance of the product in reality, especially considering the monitor settings on the customer's computer, differences in the perception of colors as the customer sees them on the screen, etc. In the case of the above-mentioned discrepancy between the product shown in the photo and the delivered product, it is not a product defect.

Product data (product description, price, etc.) displayed on the website www.the-lab.rs are subject to bugs, irregularities in the operation of the application, other technical irregularities, typographical errors, etc. In case of particular errors or malfunctions regarding product data displayed on www.the-lab.rs, the Seller reserves the right to unilaterally terminate the contract.

The subject of the order can only be products that are indicated in the order as being available and available. Due to the large number of orders submitted at the same time on www.the-lab.rs, it may happen that the information about the availability of the product is not the same as the state in the warehouse.

If the ordered product is not available in the warehouse, the Seller will inform the Customer that the product is currently unavailable, when the product will be available and at the same time offer the possibility of purchasing an alternative product from www.the-lab.rs that is available for delivery and that is closest in terms of its characteristics product that cannot be delivered.

The user bears the consequent responsibility of using the products for a purpose that is not in accordance with their purpose. Tamo Amo d.o.o. is not responsible for your product selection and any use of any product is at your own risk and without our responsibility. Before purchasing and using any product from the www.the-lab.rs Web Shop, carefully read all instructions, labels, lists of ingredients and follow the appropriate instructions for use. Tamo Amo d.o.o. takes no responsibility for any skin reactions as it is not the manufacturer. CONTRACT CONCLUSION PROCEDURE

Purchases are made on the website of TAMO AMO d.o.o. www.the-lab.rs by filling out the provided form. When filling out the form, the buyer is obliged to enter all the information requested from him. The purchase can be made with the customer's confirmation that he understood the Terms of Use as if he accepted them. Shopping is possible 24 hours a day, 7 days a week. TAMO AMO d.o.o. is not responsible for the costs of using computer equipment and telecommunication services required to access the service. The customer will be notified by e-mail about receiving the order and sending the package.

In the event that TAMO AMO d.o.o. is unable to deliver any of the ordered products, employees of TAMO AMO d.o.o. will contact the customer by phone or email. for the purpose of agreeing on the delivery of a replacement product of the same price range or will inform him of the impossibility of delivery of the replacement or ordered product.

The purchase of products in the name and on behalf of a minor or a person deprived of legal capacity (completely or partially) can only be requested by their legal representatives.

The customer can order the product after registering on the website www.the-lab.rs by clicking on the "My Account" link and clicking on "Register" and filling out the registration form. If the customer is already registered, he enters his user account by clicking on the "My Account" link, entering his e-mail address and password and clicking on "Sign Up".

On the website www.the-lab.rs, it is possible to place an order as a guest. In that case, the customer will only be asked for the data that is essential for processing the order.

The purchase is made by ordering the available products, which the customer chooses based on the photo and basic description. The purchase is made in a few simple steps in the comfort of the customer's home, or anywhere in the world.

Product search is possible according to different criteria. Entering a specific term in "Search" will display products that are related to the specified term. The customer can choose a specific product that interests him and read the available product description in order to make an independent decision whether the product meets his needs. The customer chooses products from the product catalog on the website www.the-lab.rs, which is arranged according to the types of products.

Product orders are made electronically. In the case of products that come in multiple sizes, the customer is obliged to select the size of the product in the corresponding menu.

By clicking the "Add to cart" icon, the selected product is added to the cart. By placing the product in the basket, the product is not reserved, ordered or purchased. The customer can continue to add products or review the cart by clicking "View Cart." When the customer finishes the product selection process by clicking on "View cart", he will be redirected to the page where the product in the cart is reviewed. On that page, the customer can enter a coupon code if they have one, update the price by selecting "Add code" and select delivery.

The Buyer can select "Complete purchase" after which he will be redirected to the page where the Buyer must enter his personal data. Data marked with a red star is required to continue. It is possible to deliver to an address different from the Customer's address, so if he wants to use this option, the Customer can remove the check mark next to "Invoice delivery data is the same as product delivery data" and enter the necessary data.

By clicking on "Next step", a form opens for the customer to choose the payment method.

By clicking on "Next step" again, the Order Confirmation opens, where the customer receives a final overview of the order price and the selected payment method.

It is not possible to continue the purchase without checking the "I agree to the terms of purchase" box, by checking which the Buyer confirms that he has read and understood these Terms of Use, as well as that he agrees with them. Also, the Customer cannot complete the order without checking the box "I am aware that the order includes an obligation to pay". If the customer agrees with the purchase of the products in the basket, he can click on the "Pay" icon.

After the Buyer places the order, the seller will send the Terms of Purchase to the Buyer's e-mail address together with the order confirmation with the order number confirming that the Buyer's order has been received and is being processed.

The Seller will send the Buyer to his e-mail address a confirmation of the concluded sales contract together with a confirmation that the package has been sent.

ELECTRONIC COMMUNICATION

By visiting and using the-lab.rs web shop, you accept communication via electronic means. You hereby accept that all agreements, information, notices and other contents delivered to you electronically satisfy the legal framework as if they were made in written form.

If the visitor or user does not have an e-mail address or enters an incorrect one or cannot receive e-mail due to technical reasons, the seller is not obliged to try to inform the user in any other way about the order itself, nor about any other details related to the order, delivery, payment, refund , complaints and the like.

PRICES

All prices displayed in the web shop are expressed in Serbian dinars for the end customer, including VAT.

PROMOTION PRICES are valid only during the promotion. Postponement of sending or picking up products on sale is possible only if the products have been paid for in advance, either by payment to a giro account or by card payment.

From time to time, we may offer more favorable terms for certain products than those provided for in these General Terms and Conditions, for example in connection with an extended right of withdrawal or a free return. Such preferential terms are valid for a limited time only, until certain products are sold out, and may be canceled at any time, and if we do so, these Terms and Conditions will apply without modification.

For unclaimed shipments, resending or delivery is not possible at the same prices.

Statement of Conversion

For Users (customers) who have a place of residence or residence, i.e. headquarters outside the Republic of Serbia and pay in a currency other than the Serbian dinar (RSD), all payments will be made in Serbian dinars (RSD), and the amount for which the User's credit card will be charged it is obtained through price conversion from Euro (€) to Serbian dinar (RSD) according to the valid exchange rate list of the National Bank of Serbia.

When charging with the User's credit card, the same amount is converted into the User's local currency according to the valid exchange rate list of the card issuer's association. As a result of the price conversion, there is a possibility of a slight difference in the amount compared to the original price displayed on our website.

The order is considered received:

At the moment when the order is received, the Seller will notify the customer via electronic means in the form of e-mail that the order has been received, that is, that the product has been ordered.

In the case of payment by e-banking and general payment order, the contract is considered concluded at the moment TAMO AMO d.o.o. receives confirmation that the order amount has been paid.

If the product is ordered, and e-banking or general payment is selected as the payment method, TAMO AMO d.o.o. undertakes to reserve the product in the warehouse for 2 working days, not including Saturday and Sunday. After 2 working days from receiving the order, TAMO AMO d.o.o. does not guarantee product availability.

If the ordered product is not available in the warehouse, the seller will inform the customer that the product is currently not available and in what period it will be available.

The ordered product, depending on whether it is available in the warehouse, is delivered by the seller in the shortest possible time.

DELIVERY BY COURIER SERVICE AND COSTS

We send the ordered items by courier service (Post Expres) as a package within 1 working day from the day of receiving the order or payment.

Exceptionally, due to the sale of an individual item, unforeseen circumstances, it is possible that the delivery will take a little longer than the stated deadline, about which you will be informed via e-mail.

Delivery is calculated according to the price list agreed with the courier service:

For orders with a total amount of more than 24,000.00 RSD, SHIPPING IS FREE

If the courier service changes the delivery price, the seller will clearly state the new price in the web store.

Delivery prices are shown with VAT included.

Unfortunately, we are unable to influence the speed of delivery and possible complications related to the delivery itself caused by the courier service.

If the Customer is not at the delivery address when the delivery is attempted, the courier service will leave a notification with the shipment number and instructions for further steps.

In case the Customer orders goods and refuses to receive them, TAMO AMO d.o.o. has the right to withhold from the Buyer the amount of the purchase price paid.

If the Buyer who did not receive the goods re-orders the goods via the-lab.rs Web Shop, the seller reserves the right to refuse further processing of the order as well as the right to charge.

TAMO AMO d.o.o. reserves the right not to send orders with incorrect/incomplete contact data, as well as orders with e-mails/phone numbers that no one answers.

TRANSFER OF OWNERSHIP AND OBLIGATIONS OF THE BUYER

The transfer of ownership of the ordered goods occurs at the moment of delivery of the shipment to the courier service.

TAMO AMO d.o.o. is not responsible in the event that the Buyer did not enter the delivery address correctly, and for that reason the package did not reach its destination. TAMO AMO d.o.o. is not responsible if you did not receive a notification about the change in the status of the order/sending the shipment due to the settings of your e-mail service.

In case you are not present at the delivery address, it is your responsibility to pick up the package at the courier service office within the time period determined by the courier service, or to arrange a new delivery if the engaged courier service allows such a choice.

If the package does not arrive within 3 working days of receiving notification that the package has been shipped, it is your duty to contact the engaged courier service and check where the package is.

It is the Buyer's duty to provide information about the delivery address and any additional details related to delivery (for example, additional descriptions of the delivery address if the destination is not completely clear from the address). In the absence of such information, the Seller will arrange the delivery of the goods in the best way, but then does not accept any responsibility regarding the delivery time and delivery risks.

When picking up the shipment, the buyer is obliged to check for possible damages and immediately report them to the delivery person who delivered the goods and to refuse to pick up the shipment. In that case, the shipment is returned to the Seller, and a new shipment will be sent to the Buyer.

MATERIAL DEFECTS OF THE PRODUCT

TAMO AMO d.o.o. is responsible for the material defects of the products it sells on its pages in accordance with the regulations of the Republic of Serbia.

The ordered products are packed in such a way that they are not damaged by normal handling during transport/delivery.

In the event that the shipment is damaged in transport, such damages are visible when the shipment is picked up, in that case we suggest that the Buyer does not pick up the shipment. We ask customers to contact us so that we can check the condition of the shipment as soon as possible and send a new one.

In the case of a visible lack of product when taking over the shipment, the Buyer is not obliged to take over the delivered product, he can refuse to receive it, and then he does not bear the costs of delivering such a product. It is considered that the products that were duly received by the Customer had no visible defect.

When receiving the goods, it is up to the Buyer to check the correctness of the order, the Buyer is obliged to compare the received items with the invoice, if something is missing, he is obliged to send a written complaint to the Seller within eight days because subsequent complaints will not be accepted.

By refusing to accept, the courier service will return the shipment to the Seller, noting that the shipment contains a defect. If the product has a hidden defect (a defect that could not be detected by a normal inspection when picking up the item) that the Buyer finds after opening the product - the buyer has the right to unilaterally terminate the contract and refund money, replace the product, remove the defect or reduce the price.

COMPLAINTS AND REFUNDS

The customer has the right to a justified complaint and to return the goods in the following cases:

Delivery of goods that were not ordered
Delivery of expired goods
Delivery of goods that have a fault or damage that did not occur in transport

The deadline for submitting a complaint is 8 days from receiving the package.

In the case of a request for the return of goods for justified reasons, the Buyer is obliged to send a written objection to the Seller by e-mail to team@the-lab.rs or by registered mail to the address: TAMO AMO d.o.o., Vase Čarapića 14, 11000 Belgrade.

In order to determine as quickly as possible the specific order to which the Buyer has an objection, in the objection, the Buyers are asked to state the order number, the account number or their username. TAMO AMO d.o.o. will confirm the receipt of the complaint in writing without delay and the response according to Art. 10.para.5. of the Law on Consumer Protection must arrive within 15 (fifteen) days from the day the complaint was received.

In the event of a justified complaint, the Buyer has the right to terminate the contract with a refund of the amount paid or exchange for an undamaged and valid product.

Tamo Amo d.o.o. accepts the return of the delivered products at its own expense, if it is determined that the complaint is justified and that the Customer did not affect the correctness, damage or any defect of the product. In the event of a justified complaint, the cost of replacing the product with a new product is fully borne by TAMO AMO d.o.o.

WE DO NOT ALLOW RETURNS OF USED AND CORRECT PRODUCTS.

THE RIGHT TO UNILATERAL TERMINATION OF A CONTRACT CONCLUDED OUTSIDE THE BUSINESS PREMISES OR CONCLUDED AT A DISTANCE

The consumer may, without giving a reason, unilaterally terminate this contract, within 14 days from the date of conclusion of the contract or upon its receipt.
The right to unilateral termination of the contract starts from the date of delivery, i.e. from the date of personal pickup of the shipment.
In order to exercise the right to unilateral termination, the consumer must provide the trader with a written notice stating that he is terminating the contract. The notice must be written on a permanent medium and contain the information indicated below, and can be delivered as a letter sent by post or by email to team@the-lab.rs
If the consumer exercises his right to unilateral termination, he will not bear the related costs except for the cost of returning the goods as well as the reduction in the value of the goods.
We can issue a refund only after the goods have been returned to us or after you have provided us with proof that you have sent the goods back to us.
You can fill out and send a copy of the form for unilateral termination of the contract electronically.

We will send you confirmation of receipt of notice of unilateral termination of the contract by e-mail without delay.

In order to determine the specific order against which you have an objection as quickly as possible, state the order number, invoice number or your e-mail address in the objection. TAMO AMO d.o.o. will confirm the receipt of the complaint in writing without delay, and according to the Law, the answer must reach you within 15 (fifteen) days from the date of receipt of the complaint.

In case of any dispute TAMO AMO d.o.o. and the consumer will try to resolve the dispute amicably, and if this is not possible, the court in the Republic of Serbia is competent.

DEFECTS ON PRODUCTS

The seller is not liable to the buyer or the recipient for minor scratches on the products and damage to the packaging that occurred as a result of the delivery of the goods via the delivery service, if the scratches or damage to the packaging and other minor defects do not affect the basic properties and usability of the product.
